Acceptable Use Policy

Autonomous Engineering OS. Entity: Autonomyware B.V. (Autonomyware, we, us).

This Acceptable Use Policy (AUP) explains what is and is not allowed when using the Autonomous Engineering OS and related services, interfaces and integrations (the "Services"). It forms part of the Software Agreement and of any other agreement under which we make the Services available.

1. Scope and Relationship with Other Documents

1.1 This AUP applies to everyone who accesses or uses the Services.

1.2 If this AUP conflicts with the Software Agreement or with another agreement concluded with us, that agreement prevails. The Model Provider Policies referred to in section 5 apply in addition to this AUP.

1.3 This AUP is an operational policy. It does not create warranties, service-level commitments or liability beyond those in the applicable agreement.

2. Permitted Use

2.1 You may use the Services only for lawful purposes and within the scope of your licence and Plan.

2.2 Your licence is personal. You may not share your Account or credentials, or make the Services available to other persons, unless we have agreed to this in writing.

3. Prohibited Conduct

You must not use the Services to do, attempt or assist any of the following:

3.1 Illegal activity, including violations of criminal law, data protection law, sanctions and export control law, consumer protection law, anti-fraud law or intellectual property law.

3.2 Harmful or abusive activity, including harassment, hate, threats, exploitation, unlawful discrimination, or the creation or distribution of illegal content.

3.3 Security abuse, including malware, phishing, credential theft, denial-of-service activity, unauthorised scanning or penetration attempts, or bypassing authentication, access controls, licence controls, safety controls, Credit metering or usage limits.

3.4 Use that materially degrades the stability, reliability or security of the Services for other users.

3.5 Unauthorised surveillance, covert tracking or unlawful monitoring of individuals.

3.6 Building or operating a competing service through reverse engineering, extraction of models or prompts, systematic probing of model behaviour, decompilation or disassembly, except where mandatory law expressly permits limited interoperability actions.

3.7 Submitting content that you have no right to use, including third-party copyrighted material, trade secrets or personal data processed without a valid legal basis.

3.8 Presenting AI-generated Outputs as verified or human-reviewed when they have not been reviewed.

4. Restricted Items

The Services create designs, manufacturing files and code for physical products. You must not use the Services to design, develop, improve or produce files for any of the following, and you must not attempt to circumvent any safeguards we apply to prevent this. Our safeguards do not cover every item on this list; you remain responsible for checking that your use complies with this section:

4.1 Firearms, ammunition, and parts, components or accessories of firearms, including 3D-printable or CNC-machinable parts, suppressors, and conversion devices.

4.2 Explosives, incendiary devices, detonators and their components.

4.3 Nuclear, radiological, chemical or biological weapons, their delivery systems, and equipment or materials specifically designed for them.

4.4 Other weapons, including bladed weapons prohibited by law, electroshock weapons, and weaponised drones or robots.

4.5 Military items and dual-use items, software or technology that are subject to export control, where the design, transfer or export would require an authorisation you do not hold.

4.6 Devices intended to cause injury, to defeat security or safety systems, or to facilitate crime, such as skimming devices or tools for unlawful interception.

4.7 Counterfeit goods, or products that copy protected designs, trademarks or patented inventions of others without authorisation.

5. Model Provider Policies

5.1 The Services use AI models of third-party Model Providers. When you use an Included Model, you must comply with the usage policies of the Model Provider concerned. Links to these policies are published at autonomyware.ai/terms and currently include the usage policies of OpenAI, Anthropic and xAI.

5.2 If a Model Provider Policy is stricter than this AUP, the stricter rule applies to your use of that Model Provider's models.

5.3 If you connect your own API key, you must comply with the terms and policies that apply under your own agreement with the supplier of that model.

6. AI-Specific Rules

6.1 You remain responsible for reviewing, testing and validating Outputs before any operational, legal, financial, manufacturing or safety-critical use. This includes any conformity assessment, certification and safety procedure that the law requires before a product is placed on the market.

6.2 You must not rely on Outputs as the sole basis for decisions that produce legal or similarly significant effects for individuals, unless you apply the safeguards, human oversight and notices required by law.

6.3 You must not use the Services for AI practices prohibited under the EU AI Act, or for a high-risk use within the meaning of that Act without the controls, oversight and documentation it requires.

6.4 You must not use the Services to create deceptive synthetic identities, impersonation, deepfakes intended to mislead, or disinformation.

6.5 You must not remove or alter machine-readable markings or metadata that identify Outputs as AI-generated, except where technically necessary for lawful use of the Output.

7. Data Protection and Confidentiality

7.1 You are responsible for having a lawful basis for personal data you submit to the Services and for informing the individuals concerned.

7.2 You should not submit special categories of personal data or highly sensitive personal data unless strictly necessary, lawful and appropriately safeguarded.

7.3 If you are bound by confidentiality towards others, such as your employer or clients, you are responsible for checking that you may submit their information to the Services and to the Model Providers of the models you select.

8. Security, Credentials and Access

8.1 You must keep credentials, API keys and tokens confidential.

8.2 You must promptly notify us of suspected unauthorised access, credential compromise, security incidents or misuse involving your Account.

9. Integrations and Third-Party Services

9.1 You are responsible for having the rights to connect third-party systems, APIs and data sets to the Services. Third-party services remain subject to their own terms.

9.2 You must not configure integrations to extract, transmit or store data in ways that violate law, contract or third-party rights.

10. Intellectual Property

10.1 You are responsible for the legality of your Inputs and of your use of Outputs.

10.2 You must not remove, alter or obscure ownership notices, licence notices or attribution required by law, contract or open-source licence terms.

11. Minimum Age

11.1 The Services are intended for persons aged 18 or over. You must not use the Services to process children's data unlawfully or to target children in violation of applicable law.

12. Export Controls and Sanctions

12.1 You must comply with applicable export control and sanctions laws. Designs, manufacturing files and code created with the Services may themselves be controlled technology.

12.2 You must not access or use the Services from countries or for end uses where this is prohibited, or from countries in which we or our Model Providers do not offer the Services.

13. Monitoring and Enforcement

13.1 To protect users, our infrastructure and compliance with law, we apply proportionate safeguards, including abuse monitoring, safety filters, rate limits and risk-based restrictions.

13.2 Where we reasonably determine that use violates this AUP, the Model Provider Policies, applicable law or the applicable agreement, we may investigate, require remediation, block specific Outputs or Features, suspend access or terminate access, in accordance with the applicable agreement.

13.3 We may act immediately where necessary to prevent harm, preserve security, meet legal requirements or comply with a Model Provider's instruction.

13.4 Our safeguards are risk-based and may not detect or prevent every misuse. The absence of a safeguard does not mean that a use is permitted.

14. Reporting

14.1 Please report misuse, security issues or violations of this AUP to legal@autonomyware.ai or support@autonomyware.ai.

15. Changes

15.1 We may update this AUP for legal, security, product or operational reasons. Material changes are communicated in accordance with the applicable agreement.
